Mr Walker of White Lodge, Bunts Lane, spoke on application 04/P1243 Bunts Hill Cottage, which he said was not being constructed in accordance with the planning approval or conditions as agreed by EDDC. He referred to the letter from his solicitor which had been circulated to members. He said he understood that the matter was due to be discussed by EDDC Development Control committee shortly. He sought the Town Council’s support for his submission that the dwelling should be demolished and re-built in accordance with the conditions agreed.

Minutes of the meeting held on 13th November 2006 were approved and signed by the Chairman.
Cllrs Burrows and Garner advised that they were not members of this committee and would therefore not vote on any matters.
There was some concern at the use of white pvc but Members recommended Approval by 6 votes to 1

It was agreed that the terms of reference for such a Working Party would be limited to seeking expert guidance and obtaining detailed information for the benefit of the Planning Committee, which is the body responsible for responding to applications.
It was agreed by 5 votes in favour and 1 against (Cllr Pigott) that a Working Party be established as proposed.

Ashfords Solicitors – land adjacent to Bunts Lane, Seaton
Members expressed unanimous concern that planning approval conditions could potentially be so easily flouted, as was being suggested in this instance. They were also very concerned that building had been allowed to progress as far as it had, and had not been halted when concerns were first raised that planning conditions were being ignored. Members were appalled at the suggestion that the deviations from the approved plans could be approved as minor amendments. It was noted that the original applications had been refused by the Town and District Councils, but what was now being built more closely resembled the original than the design that was finally approved. It was further noted that following a visit by the Enforcement Officer, a new application had been requested. However, no application had been submitted and building had continued.
It was unanimously agreed that Mr Walker should receive the utmost support in ensuring that the development complied with the planning conditions, and any deviation from those conditions should not be permitted.
It was noted that the Development Control Committee was meeting on 13th December when this application would be discussed, and Members requested that they be advised of that committee’s recommendation.
Copies of all Minutes of all the Council's meetings are held in the Council Office and copies are sent to Seaton Library once they have been signed by the chairman as a true record of proceedings at the subsequent meeting.
