QUESTIONS FROM THE PUBLIC

Sally Cook of Major Terrace spoke on planning application 07/0090/FUL 4 Major Terrace. She urged the Council to refuse the application on the same grounds as previously: loss of light, loss of privacy, access to fire escape dangerous, no access for building work, overdevelopment. She said it is a back yard only and not suitable for development.

Mrs Price of 21 Court Lane spoke on application 06/3157/OUT 25 Court Lane, Seaton. She queried whether the planning authority investigated proposed applications prior to submission. She was advised to raise any issues of concern for the attention of the planning department. She said she was concerned that the service road was not suitable for an additional four houses, nor were the drain and sewerage systems. She also said that whilst the ownership of the road was unclear, it was a private road.

Mr Greenyer of Marlpit Lane spoke on application 07/0210/RES 27 Marlpit Lane. He said this application, as in the previous 2 applications which had been refused by Seaton Council and by EDDC, did not conform with the approved outline plan in terms of size. He said that although there were large properties in Marlpit Lane, those surrounding the proposed dwelling were not large, the properties opposite being semi-detached and set back from the road. He said the latest application showed a reduction on the north side only. He said he believed the proposal was still overdevelopment and inappropriate for the plot. He said to approve it would make a nonsense of the planning process because it did not conform with the approved outline plan.

Minutes of the meeting held on 22nd January 2007 were approved and signed by the Chairman with an agreed amendment to the final sentence of Cllr Meakin’s statement to read “…..there was insufficient open space, the monsoon drain was not appropriate and the proposal for flat bottomed boats and high wheeled vehicles was ludicrous”.

Cllr Morgan declared a prejudicial interest in planning application 07/0079/FUL, Thornfield, 87 Scalwell Lane, Seaton, being a close friend of the applicant.

459/06TO CONSIDER THE FOLLOWING PLANNING APPLICATIONS

a) 07/0059/FUL erection of 3 bedroomed bungalow, Lane End, Harepath Road, Seaton (amended plans)

Members unanimously recommended Refusal on the same grounds as previously, i.e. insufficient space and therefore overdevelopment; loss of privacy to neighbouring property at 26 Boundary Park; unsafe access for traffic and pedestrians onto highway. They believe that the amendments show little change to the original application.

b) 07/0079/FUL extensions and alterations to care home, Thornfield, 87 Scalwell Lane, Seaton

Members unanimously recommended Refusal on the grounds of overdevelopment, inadequate drainage, loss of privacy to neighbours, loss of light to neighbours. Members requested an inspection of the plans by the Fire Inspector as they believed that there could be inadequate access for fire appliances.

Cllr Seward commented that it was unfortunate to have to put objections in the way of the expansion of local private business, but the proposals would have a detrimental effect on neighbours.

Cllr Burrows declared that he was not a member of the committee and would therefore not be voting on any applications.

c) 07/0090/FUL extension to rear to provide a 1 bedroomed flat, 4 Major Terrace, Seaton

Members unanimously recommended Refusal on the same grounds as for the two previous applications at this site; overdevelopment, loss of privacy, loss of light, inappropriate development in a conservation area, lack of access, health and safety issues arising from an access that is too narrow, obstruction of back yard creating a fire hazard.

d) 07/1200/ADV display of non-illuminated fascia and hanging sings, Lloyds TSB Bank plc, The Square, Seaton

Members unanimously recommended Approval on the grounds that this amended application complied with the requirements of the Planning Department

e) 07/0210/RES erection of detached dwelling, 27 Marlpit Lane, Seaton

Members unanimously recommended Refusal on the same grounds as the 2 previous applications for this site which had all been refused; i.e the proposal was inappropriate and disproportionately large for the plot. They said that the outline planning application for this site had been approved for a dwelling of approximately 1500 square feet. Each subsequent application, however, has been for a dwelling of between 3,000 and 4,000 sq ft which is over twice the size approved in application 05/1282/OUT. Applications 06/0609, 06/2476 and 07/0210 show dwellings which are not in proportion with neighbouring properties, those opposite the site being semi-detached and set back from the road.

f) 07/0220/FUL retention of conservatory 3 Larch Close, Seaton

Members unanimously recommended Approval

The Clerk was requested to acknowledge and forward to EDDC

b) EDDC – appeal, land at 27 Marlpit Lane, Seaton

The Clerk was requested to make a further representation that the appeal application did not comply with the approved outline application.

c) EDDC – appeal – Windsor Cottage, Cross Street, Seaton

Members had recommended approval of this application and therefore had nothing to add.
